Defendant must disclose alibi witnesses before South Dakota slaying trial

RAPID CITY, S.D. - A judge has ruled on whether a Canadian man has to tell U.S. federal prosecutors where he was when a fellow American Indian Movement member was killed.
John Graham stands trial starting Oct. 6 in federal court in Rapid City for first-degree murder in the slaying of fellow Canadian Anna Mae Pictou Aquash on the Pine Ridge Indian Reservation.
Her body was found in February 1976.
U.S. District Judge Lawrence Piersol said if the defence plans to call alibi witnesses, those names must be given to government lawyers before the trial.
But if Graham has documents or plans to testify himself, he does not have to disclose that.
